By accessing or using the Services, you acknowledge that your information may be processed as described in this Privacy Policy. Where applicable law requires consent for a particular processing activity, we will obtain consent as required by applicable law.
This Privacy Policy forms part of, and is incorporated into, our Terms of Service. Your use of the Website and Services is also governed by our Terms of Service. If you do not agree with this Privacy Policy or the Terms of Service, you should not use the Website or Services.
Words whose initial letter is capitalized have meanings defined in this section or in the Terms of Service. The following definitions shall have the same meaning whether they appear in singular or plural.
For the purposes of this Privacy Policy:
- “Account” means a unique account created for you to access our Service or parts of our Service.
- “Company” (referred to us as either “the Company”, Mobizma, “we”, “us”, or “our” in this Policy) means Mobizma LLC.

- “You” means the individual accessing or using the Service, or the company or other legal entity on whose behalf such individual is accessing or using the Service, as applicable.
- “Non-Personal Information” (“NPI”) is Usage and Technical Information that is not personally identifiable to you and that we automatically collect when you access our Website with a web browser (for example, device type, browser type, and general usage data). This information may constitute personal information/personal data under applicable law.
- “Personally Identifiable Information” (“PII”) is any information that can be used on its own or with other information to identify, contact, or locate an individual (for example, name, email address, phone number, billing details).
- “Personal Data” means any information relating to an identified or identifiable natural person. PII is one type of Personal Data.
- “Processing” means any operation or set of operations which is performed on Personal Data or on sets of Personal Data (such as collection, recording, organization, storage, adaptation, use, disclosure, and deletion).

In providing the Services, Mobizma may receive, access, collect, transmit, store, or otherwise process Client Data submitted or provided by a Client or collected through systems, websites, forms, advertisements, communications, CRM records, or other integrations configured for a Client.
Depending on the services purchased and the Client's configuration, Client Data may include names, telephone numbers, email addresses, postal addresses, lead information, customer records, appointment information, forms and submissions, communications, call recordings and transcripts, notes, service histories, preferences, and other information supplied by or collected from individuals.
With respect to Client Data, Mobizma generally acts as a service provider, processor, or other technology and service provider acting on behalf of the applicable Client.
The Client generally determines:
what information is collected;
from whom it is collected;
the purposes for which it is collected and used;
what communications are sent;
what services are offered;
what retention periods apply; and
what legal basis, consent, authorization, or other permission is required.
Mobizma processes Client Data primarily as necessary to provide the Services in accordance with the Client's instructions and the applicable agreement between Mobizma and the Client.
Where Mobizma processes Client Data on behalf of a Client, the Client's privacy policy, notices, terms, consent practices, and other applicable disclosures may govern the Client's collection and use of that information.
The Client is responsible for its own collection, use, disclosure, and other processing of Client Data and for complying with all laws and regulations applicable to its activities.
This includes responsibility for:
obtaining required consents, permissions, authorizations, and opt-ins;
providing required privacy notices and disclosures;
maintaining lawful and accurate customer, prospect, lead, subscriber, and contact lists;
determining whether an individual may lawfully be contacted by telephone, SMS, email, voice, or other communications;
maintaining and honoring opt-out, unsubscribe, suppression, deletion, and do-not-contact requests;
ensuring that information supplied to Mobizma is lawfully obtained and appropriate for processing;
determining whether information is sensitive, regulated, confidential, protected, or subject to industry-specific requirements;
determining whether GDPR, HIPAA, CCPA/CPRA, or other privacy or industry-specific requirements apply;
configuring the Services appropriately for its legal and regulatory obligations; and
maintaining any required agreements, notices, consents, authorizations, policies, and procedures.
Client accounts provisioned by us are not HIPAA compliant by default. Where HIPAA functionality is required, the applicable HIPAA monthly subscription package and required Business Associate Agreement must be separately activated/executed where applicable. Our HIPAA is powered by GHL (HighLevel), who states that its HIPAA provides features including ePHI encryption, audit logging, MFA enforcement, and a BAA.
Mobizma does not generally independently verify whether a Client has obtained all legally required consents, permissions, authorizations, or notices relating to Client Data supplied to or processed through the Services.
A Client's use of the Services does not transfer the Client's legal or regulatory responsibilities to Mobizma.
We are committed to processing Personal Data in accordance with applicable data protection laws and the following principles:
- Lawfulness, fairness, and transparency: We will process your Personal Data lawfully, fairly, and in a transparent manner and provide you with information about that Processing upon request.
- Purpose limitation: We will process Personal Data only for specified, explicit, and legitimate purposes and will not further process it in a manner incompatible with those purposes.
- Data minimization: We will collect and process only the minimum amount of Personal Data needed for any purpose.
- Accuracy: We will take reasonable steps to ensure that Personal Data is accurate and kept up to date.
- Storage limitation: We will not store Personal Data for longer than necessary for the purposes for which it is processed, except where a longer retention period is required by law.
- Integrity and confidentiality: We will use appropriate technical and organizational measures to ensure the security, integrity, and confidentiality of your Personal Data.
- Accountability: We will maintain appropriate records and be able to demonstrate compliance with these principles.
Mobizma applies these principles to the extent applicable to the particular processing activity and Mobizma's role in that processing.
Where Mobizma processes Client Data on behalf of a Client, the Client is responsible for determining the applicable lawful basis, purposes, retention requirements, notices, and other obligations applicable to that processing.
If you are an EU or UK resident, we endeavor to comply with the General Data Protection Regulation (“GDPR”) and any applicable local data protection laws.
You generally are not required to provide Personal Data merely to browse the Website.
However, we may collect Personal Data when you voluntarily provide it to us, including when you:
- complete forms, surveys, or applications;
- request information, resources, or support;
- sign up for newsletters, webinars, or events;
- create an Account or log in to a portal;
- start a trial, purchase a product, or subscribe to a service;
- communicate with us via email, SMS, phone, or chat.
The types of Personal Data you may provide include:

- Business name and related details;

- Phone number (including mobile number);

When you use the Website or Service, we may automatically collect certain technical and Usage Information, which may include:
- Your Device’s IP address;

For Client Data, Mobizma uses information primarily to provide the Services requested by the applicable Client, in accordance with the Client's instructions and applicable contractual arrangements.
We may also process information as necessary to maintain security, prevent fraud or abuse, troubleshoot and improve the Services, comply with law, enforce our agreements, and protect our rights and those of others.
No mobile information will be shared with third parties or affiliates for marketing/promotional purposes
Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the Text Message services.
Mobizma does not independently operate all of the infrastructure, technology, communications systems, hosting environments, payment systems, analytics systems, artificial intelligence systems, or other technologies used to provide the Services. We rely on third-party technology and infrastructure providers.
We may disclose or make Client Data available to third-party service providers and subprocessors where reasonably necessary to provide the Services to the applicable Client, subject to applicable contractual and legal requirements.
We may also process information as necessary to maintain security, prevent fraud or abuse, troubleshoot and improve the Services, comply with the law, enforce our agreements, and protect our rights and those of others.
We may share your Personal Data with Service Providers and business partners who perform services on our behalf, such as:
cloud hosting and infrastructure;
CRM and marketing automation;
email, SMS, voice, and telecommunications;
artificial intelligence and machine-learning functionality;
analytics and measurement;
payment processing;
customer support;
authentication and security;
website hosting and content delivery;
data storage and backup; and
other technology necessary to operate and deliver the Services.
These parties are authorized to use your Personal Data only as necessary to provide their services to us and are required to protect it appropriately. These providers may process or store information as necessary to provide their services to Mobizma or our Clients.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
When Mobizma processes telephone numbers, SMS content, messaging records, or related information on behalf of a Client, Mobizma does so as a service provider or processor for that Client in connection with the Client's own sub-account and use of the Services. The Client is responsible for its own KYC, A2P, dedicated phone numbers, customer relationships, lead and contact lists, consent and opt-in practices, privacy notices, messaging practices, and compliance with applicable laws.
The Client's applicable terms of service, privacy policy, notices, and consent practices govern the Client's relationship with the individuals whose information the Client provides to or processes through the Services.
Mobizma does not sell or rent Client Data or mobile opt-in information for Mobizma's own independent marketing purposes.
Mobizma uses HighLevel as a third-party CRM, automation, communications, and related technology platform.
Client accounts operate within separate HighLevel sub-accounts or locations.
HighLevel states that its platform uses logical tenant separation to separate customer data, role-based authorization controls, access logging, and other technical and organizational safeguards. HighLevel also states that data is encrypted in transit using TLS 1.2 or 1.3 and encrypted at rest using AES-256.
HighLevel's current Data Processing Addendum describes them as a processor of Customer Personal Data and addresses subprocessors, security measures, data-subject rights, deletion, international transfers, and applicable data protection laws.
GoHighLevel (GHL) implements several robust security protocols to ensure the safety and integrity of data stored in sub-accounts. These protocols are designed to protect user information and maintain compliance with data protection standards.
Data Encryption
In Transit: All data transmitted between users and GoHighLevel servers is encrypted, ensuring that sensitive information is secure during communication.
At Rest: Data stored within the platform is also encrypted, protecting it from unauthorized access even if intercepted.
Role-Based Access Controls - allowing for tailored control over who can view or modify data.
Secure Hosting and Infrastructure - with automated backups and audit logging, data.
GHL product infrastructure resides in the United States. GHL uses leading cloud infrastructure providers such as Google Cloud Platform Services and Amazon Web Services, and relies upon Google’s and AWS’s audited security and compliance programs for the efficacy of their physical, environmental, and infrastructure security controls. This Enterprise-level service reliability ensures redundancy to all power, network, and HVAC services. The business continuity and disaster recovery plans for the AWS services have been independently validated as part of their SOC 2 Type 2 report and ISO 27001 certification. AWS’s compliance documentation and audit reports are publicly available at the AWS Cloud Compliance Page and the AWS Artifacts Portal.
All customer content hosted on the platform is protected by firewall and application security. The monitoring tools actively monitor the application layer and can alert on malicious behavior based on behavior type and session rate. The rules used to detect and block malicious traffic are aligned to the best practice guidelines documented by the Open Web Application Security Project (OWASP), specifically the OWASP Top 10 and similar recommendations. Protections from Distributed Denial of Service (DDoS) attacks are also incorporated, helping to ensure customers’ web sites and other parts of the HighLevel products are continuously available.
Compliance with Data Protection Standards - including GDPR, TCPA and CAN-SPAM, and HIPAA (when applicable).
Disaster recovery and resiliency operations are managed by HighLevel product engineering teams. In some cases, customers can use the recycle bin to directly recover and restore contacts, opportunities, custom fields, custom values, tags, notes, and tasks up to 30 days after they were deleted. Changes to web pages, blog posts, or emails can be restored to previous versions of content using version history. For customers who wish to additionally back up their data, the HighLevel platform provides many ways of ensuring that you have what you need.
Many of the features within your HighLevel portal contain export options, and the HighLevel library of public APIs can be used to synchronize your data with other systems.
Mobizma does not own or independently control the underlying infrastructure operated by third-party providers.
Accordingly, to the maximum extent permitted by applicable law, Mobizma is not responsible for the independent acts, omissions, security practices, availability, outages, vulnerabilities, failures, changes, or other conduct of third-party infrastructure or technology providers, except to the extent that applicable law or a written agreement expressly provides otherwise.
Mobizma selects and uses third-party providers that it considers appropriate for providing the Services, but no third-party infrastructure can be guaranteed to be completely secure, uninterrupted, or error-free.
Some parts of the Service may allow you to publish content (for example, testimonials, comments, reviews). Information that you choose to make public may be visible to others, indexed by search engines, and copied or shared by third parties. You should not post any Personal Data or sensitive information in public areas that you do not wish to be publicly available.
If we are involved in a merger, acquisition, restructuring, or sale of assets, your Personal Data may be transferred as part of that transaction, consistent with applicable law and subject to appropriate safeguards.
We may disclose your Personal Data if we believe in good faith that such action is necessary to:
- Comply with a legal obligation or valid request from public authorities;
- Protect and defend the rights or property of Mobizma;
- Prevent or investigate possible wrongdoing in connection with the Service;
- Protect the personal safety of users of the Service or the public;
- Protect against legal liability.
If you are located in the European Economic Area (“EEA”), the United Kingdom, or another jurisdiction with similar privacy rights, applicable data protection law may provide you with rights concerning your Personal Data.

- Right to rectification – to request correction of inaccurate or incomplete Personal Data.

Where GDPR or similar laws apply and Mobizma acts as a controller, we may rely on one or more of the following legal bases:

our legitimate interests, where those interests are not overridden by your rights and interests; and
other lawful bases available under applicable law.
Where Mobizma processes Client Data on behalf of a Client, the Client generally determines the purposes and legal basis for processing, and Mobizma processes the information in accordance with the Client's documented instructions and applicable contractual requirements.
GHL's current DPA likewise distinguishes between a customer acting as controller and HighLevel acting as processor, and between a customer acting as processor and GHL acting as subprocessor.

We may need to verify your identity before processing a request.
If your request concerns Client Data that Mobizma processes on behalf of one of our Clients, we may refer your request to the applicable Client or provide the request to that Client for handling, as appropriate under applicable law and our contractual relationship.
If you believe your privacy rights have been violated, you may contact us. Where applicable, you may also have the right to lodge a complaint with the data protection or supervisory authority in your country of residence, workplace, or place of the alleged infringement.
Our Service is not directed to children under the age of 13, and we do not knowingly collect Personal Data from children. If you are a parent or guardian and believe that your child has provided us with Personal Data, please contact us so that we can take appropriate steps to delete such information.
We follow the principles of the Children’s Online Privacy Protection Act (“COPPA”) where applicable. If we learn that we have collected Personal Data from a child under 13 without verifiable parental consent, we will delete that information as soon as reasonably practicable.
Children should always obtain permission from a parent or guardian before using the Internet or providing Personal Data online.
We are committed to keeping your email address confidential. We do not sell, rent, or lease our subscription lists to third parties. We may use your email address to communicate with you about the Service, including:
- transactional and account-related messages;
- support and service notifications;
- marketing and promotional content (where permitted by law and subject to your preferences).

Mobizma may provide email, SMS, telephone, voice, chat, and other communication functionality to Clients. When those communications are initiated, configured, or directed by a Client, Mobizma generally acts as a service provider or processor on behalf of that Client. The Client is responsible for determining whether the communication is lawful and whether the recipient has provided any consent or authorization required by applicable law.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties except as necessary to provide the messaging services or as otherwise permitted by applicable law.
When you provide your mobile number to Mobizma and opt in to receive SMS or text messages, you expressly consent to receive messages related to:
- account notifications and alerts;
- transaction confirmations and billing notices;
- service updates and maintenance notifications;
- customer support communications;
- marketing and promotional messages, where permitted by law.
Message frequency may vary. Message and data rates may apply as determined by your wireless carrier. Your consent to receive SMS messages is not a condition of purchase.
We are committed to protecting your mobile information:
- We do not sell or rent our business leads or customer phone numbers to third parties for their own marketing purposes.
- Phone numbers may be shared only with authorized Service Providers who assist us in delivering SMS messages or operating the Service.
- We take reasonable technical and organizational measures to protect phone numbers and message data against unauthorized access.
- We generally retain SMS message logs for a limited period necessary for business, compliance, and troubleshooting purposes.
- Mobizma may process phone numbers and message content as a service provider to its business clients in their own sub-accounts. The client's own terms of use and service, as well as privacy policy and consent practices apply for every individual sub-account. Mobizma is not responsible or liable for any client business.
You can opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After you send STOP, you may receive one additional message confirming that your request has been processed.

Standard message and data rates may apply to all SMS messages sent to or from us.
Mobizma retains Personal Data for only as long as reasonably necessary for the purposes described in this Privacy Policy, to provide the Services, to maintain business and transaction records, to resolve disputes, enforce agreements, maintain security, comply with legal obligations, or for other legitimate business purposes permitted by applicable law.
Retention periods may vary depending on the nature of the information, the purpose for which it was collected, contractual requirements, legal obligations, and applicable Client instructions.
GHL keeps canceled account data for 90 days after cancellation.
During this 90-day period, you can reactivate your account to regain access and retain your data. HighLevel also sends automated reminder emails before permanent deletion. Once an account is permanently deleted, the process is final and cannot be reversed.
Our customers are responsible for ensuring they only capture appropriate information to support their marketing, sales, services, content management, and operations processes. The access we provide to the CRM and or other products should not be used to collect or store sensitive information, such as credit or debit card numbers, financial account information, Social Security numbers, passport numbers, financial or health information except as otherwise permitted.
Disaster recovery and resiliency operations are managed by HighLevel product engineering teams. In some cases, customers can use the recycle bin to directly recover and restore contacts, opportunities, custom fields, custom values, tags, notes, and tasks up to 30 days after they were deleted. Changes to web pages, blog posts, or emails can be restored to previous versions of content using version history. Customers can additionally back up their data. Many of the features within your HighLevel portal contain export options, and the HighLevel library of public APIs can be used to synchronize your data with other systems.
With respect to Client Data, the applicable Client generally determines the appropriate retention period, subject to the applicable agreement and the technical capabilities and requirements of the underlying Service.
Upon termination of Services, Client Data may be deleted, returned, exported, or retained for a limited period in accordance with the applicable Client agreement, applicable law, backup procedures, and the policies of relevant third-party service providers.
If you choose to purchase products or services from us, your payment will be processed by our third-party payment processors.
We do not store full credit card numbers on our servers.
Payment processors may collect and store your payment card details in accordance with their own privacy and security policies.
We use commercially reasonable technical, administrative, and organizational safeguards designed to protect your Personal Data from unauthorized access, use, disclosure, alteration, loss, or destruction.
However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use reasonable means to protect your Personal Data, we cannot guarantee its absolute security.
Mobizma does not represent or warrant that the Services or any third-party infrastructure will be uninterrupted, completely secure, or free from vulnerabilities, errors, or unauthorized access.
Where information is processed through third-party infrastructure providers, the security of that information also depends on the security controls and practices maintained by those providers.
HighLevel currently states that its platform uses encryption in transit using TLS 1.2/1.3 and encryption at rest using AES-256, as well as tenant separation, access controls, logging, and other security measures.
The Service may contain links to third-party websites, applications, or services that are not operated by Mobizma. If you click on a third-party link, you will be directed to that third party’s site.
We strongly advise you to review the privacy policy of every site you visit. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.
We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date at the top of this Privacy Policy. In some cases, we may provide additional notice (such as by email, SMS, or a prominent notice on the Website).
Changes become effective when posted unless otherwise stated. Where applicable law requires additional notice or consent, Mobizma will provide such notice or obtain such consent.
